GENERAL FREQUENTLY ASKED QUESTIONS

Who should take MPowder

Can MPowder products be taken alongside HRT or BHRT?

Every women's menopause journey is different and it is important you find the right support for your body. MPowder is designed to provide the nutritional foundation layer and none of our ingredients have known contra-indications if taken with HRT. Many women take our powder alongside their prescription. However, if you're in doubt, please seek advice from your prescribing doctor/health professional.

I have a history of breast cancer in my family / I have been diagnosed with breast cancer myself. Are your powders safe for me to take?

The medical guidance around the inclusion of isoflavones in the diet, and in supplements, for women with a history of some cancers is mixed. Our advice, without knowing the detail of your story, would be not to take our powders - but to email us at info@mpowder.store and we will be in touch when our isoflavone-free range launches next year.

When should I start taking products from the MPowder range?

Every woman, regardless of symptoms, will benefit from starting the Peri-Boost programme as her bio-chemistry changes. The average age in the UK is 43. But some women experience peri-menopause much earlier.

How do I know which powder is right for me?

Our MPowder Match tool is designed to help you select the right powder for the lifestage you are in, now. But if you are in doubt, please email us at info@mpowder.store.

How to take MPowder

How do I measure out 30g?

Simply measure out 3 level tablespoons to make sure you get your daily recommended 30g dose.

Why do you suggest that your powders are taken before lunch?

Our powders contain a rich mix of natural energy giving sources. Taking MPowder before lunch ensures we can power you through your day, rather than keep you awake at night!

Should MPowder replace my morning coffee?

Many of our MPowder Makers find that a morning hit of MPowder gives them the energy they need to FINALLY break their coffee habit. Our advice is to monitor your response to our Powders. If you find yourself feeling 'wired', that will be the cacao! - and you should then give further time between taking our scoop and your first coffee of the day.

Why do you suggest that your blend is taken within 30 minutes of mixing?

MPowder is free from caking agents and bulking agents and packed full of whole foods. This means the mixture can separate if left to stand more than 30 minutes after blending.

What to expect

I've started noticing my stools are looser - is this normal?

In the first 1-3 weeks, some women may experience an increase in bowel movements and changes in stool consistency. However, if you experience extreme discomfort or diarrhoea it may be that you need to introduce our product more gradually to manage its detoxifying properties. See below.

What do I do if I get an upset stomach in the first weeks of introducing MPowder to my daily routine?

If you have extreme symptoms, however much you think they may be associated with MPowder, please seek immediate help from a medical professional. If, however, you are experiencing bloating, diarrhoea or an upset stomach, our advice is to stop the product for 2 days. Let your body rebalance and then slowly introduce our powder back into your routine at a dosage of 10g (1 level tablespoon) for 3 days, and then 20g (2 level tablespoons) for 3 days. And, if you still feel good, return to the recommended daily dose of 30g (3 tablespoons), on day 7. Also, avoid taking it on an empty stomach or too cold.

What do I do if my stomach remains upset whenever I take MPowder?

If you continue to struggle taking MPowder comfortably, please drop us a line at info@mpowder.store.

I'm already taking a number of supplements. Should I stop these when I start taking your powders each day?

Yes - ish! MPowder is designed to deliver a complete nutritional boost for the three bio-chemical stages of menopause. This means that you don't need to purchase additional supplements to get the foundational support your body needs. The one additional supplement you may want to consider or continue, is a good high dose source of Omega-3.

I find the taste of the powder very bitter with water. What can I do to integrate a scoop into my every day?

Your taste buds are as individual as your body. Our Makers have many ingenious recipes to share. For the sweet-toothed, for the protein ball addict, for the mint lover, we've got tried and tested blends to help you find a solution that works.

How quickly should I see results?

Our research and work with our Makers indicates that most women start to see improvements to their symptoms within 4-6 weeks. But every body is different. And how you live, plus outside factors play a huge part in how you transition through menopause. Our recommendation is to commit to taking MPowder every day for 3 months. And to work with us to introduce other lifestyle changes to really see an impact.

How can I tell if your powder works?

Each of our products contains ingredients that have shown potential in the lab and results in real life. In addition, each powder is tested first by our Makers so we can check the final blend delivers as we intend. But every body is different. Any nutritional change to diet takes 4-8 weeks for effects to be truly seen. Which is why we recommend you subscribe.

We hope you love our products, and we want to support you the best we can. Our returns policies below are clear and simple and designed with this in mind.

Contact us on yourteam@mpowder.store and we will resolve it straight away, either by sending you new product or arranging a refund.

If you’ve changed your mind:
You can return the product to us within 14 days of receipt, so long as it is unopened and in saleable condition. If your order has qualified for a free gift, the gift must also be returned before your refund or replacement can be processed. Please contact yourteam@mpowder.store for details.

To be eligible for a refund your items must be unopened with all packaging seals in tact, and in the same condition that you received them. Pouches must be returned in the box they were delivered in to protect them. Please be aware that due to EU hygiene regulations we cannot offer a refund, replacement or exchange on items returned in non-saleable condition, including those damaged in transit due to being poorly re-packed.

How do I return my order?

Email us on yourteam@mpowder.store with your order number and detailing the reason for your return. We will email you a returns note and address label.

Please place unopened pouches in the box they were delivered in with any packing material to fill the box. If items are sent crushed in small packages without a cardboard box we unfortunately won't be able to give a refund.

Please include the returns note that we have emailed you inside the parcel so our returns team know exactly what to do with it. Failure to do this will delay the refund process.

Stick the returns address label that we have emailed to you on the outside of the box. Please make sure it is secure and the full address is clearly visible.

Please note: We advise customers to take all necessary precautions to ensure that their parcels are sent via a secure and reputable courier company.

We recommend sending your parcel via myHermes or UPS as this is a much cheaper option than Royal Mail. You can take your parcel to one of their 4,500+ parcel shops across the UK.

We do not take responsibility for parcels lost in transit so please retain your proof of postage/ delivery.

Do I pay for the return postage?

Unless the Products are faulty or not as described, you will be responsible for the cost of returning the Products to us.

Any qualified returns will receive refunds in the amount of the original product price less any applicable return label fees. The refund will be made to the original payment method used and can take up to 14 working days to go through. We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable.

You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you.

You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided 'as is' and 'as available' for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.

In no case shall MPowder, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

SECTION 15 - INDEMNIFICATION

You agree to indemnify, defend and hold harmless MPowder and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

SECTION 16 - SEVERABILITY

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

SECTION 17 - TERMINATION

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.

If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

SECTION 18 - ENTIRE AGREEMENT

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.

SECTION 19 - GOVERNING LAW

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the relevant geographical territory.

SECTION 20 - CHANGES TO TERMS OF SERVICE

You can review the most current version of the Terms of Service at any time at this page.

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the Service following the posting of any changes to these Terms of Service constitutes acceptance of those changes.

SECTION 21 - RETURNS POLICY

We hope you love our products, and we want to support you the best we can. Our returns policies below are clear and simple and designed with this in mind.

If there is a fault or issue:
Contact us on yourteam@mpowder.store and we will resolve it straight away, either by sending you new product or arranging a refund.

If you’ve changed your mind:
You can return the product to us within 14 days of receipt, so long as it is unopened and in saleable condition. If your order has qualified for a free gift, the gift must also be returned before your refund or replacement can be processed. Please contact yourteam@mpowder.store for details.

If you don’t like the product:
We want to help you have the best experience of our products and love them as much as we do. But your tastebuds are as individual as you are. If you're having any issues with taste please contact us immediately at yourteam@mpowder.store and we’ll work with you to try and find the right recipe. We've got lots of tips and recommendations from our experts and MPowder community, we can share too. Please note we do not issue refunds on the basis of flavour.

Once your return is received and inspected, we will send you an email regarding your refund. The refund will be made to the original payment method used and can take up to 14 working days. If your card has expired since your purchase please contact us on yourteam@mpowder.store to advise. Please note this may delay the refund process.

How to Return Your Order
Email us on yourteam@mpowder.store with your order number and the reason for your return. We will email you a returns note and address label. The unopened pouch should then be placed in the original box along with the return note and any packing material to fill the box. Failure to include the return note will delay the refund process. The Product must only be sent to the address confirmed in the email. If sent to any other address we will not be able to process your return.

We advise customers to take all necessary precautions to ensure that their parcels are sent via a secure and reputable courier company. We do not take responsibility for parcels lost in transit so please retain your proof of postage/ delivery. Please note, unless the Products are faulty or not as described, you will be responsible for the cost of returning the Products to us.

SECTION 22 - DELIVERY

We will deliver to your chosen address. Please ensure your delivery address is correct. Any failed deliveries due to incorrect or incomplete details will delay your delivery and may incur additional costs as deliveries will be returned to us and then re-dispatched.

If you request your delivery is left in a safe place or with a neighbour please note we do not accept responsibility for any loss or damage in this instance.

For deliveries to work addresses you must ensure that your employer allows personal deliveries and that any delivery points/details given for a work address are correct. Again any delivery issues arising as a result of incorrect details or a refusal to take the parcel at your work address may incur additional costs as deliveries will be returned to us and then re-dispatched.

We use a third party courier for deliveries and do not guarantee delivery dates. Whilst we do our utmost to deliver as quickly as possible all dates are indicative only.

Refused deliveries: if you reject your order at the door, are repeatedly unavailable for delivery, or don't collect your parcel from a pick up shop, we will refund you once the parcel has reached our fulfilment centre. Our carriers charge us £10 for returning the parcel to us, so this amount will be deducted from your refund to cover this cost.

SECTION 23 - CONTACT INFORMATION

Questions about the Terms and Conditions should be sent to us at info@mpowder.store.

We have appointed a data privacy manager who is responsible for looking after questions about this privacy policy. If you have any questions about this privacy policy, including any requests to exercise your legal rights, please see How to contact MPowder about privacy below.

3. HOW WE COLLECT DATA

There are lots of different ways in which we may collect data, or receive data, and you can see an explanation of the main ways below.

You may give us data when you interact with us

You may give us data by filling in forms or by corresponding with us by post, phone, email or through chat or social media. This includes data you provide when you:

  • sign up to receive our newsletter;
  • make enquiries or request information be sent to you;
  • create an account on our website;

  • permit or ask for direct marketing to be sent to you;
  • use ‘refer a friend’;

  • contact customer services; or
  • leave comments or reviews on our products or services
  • track or share your symptoms with us via sms, email or interviews

We may get some data automatically

As you interact with us, including via the MPowder website, we may automatically collect data about your equipment, browsing actions and patterns. We may also collect data when you click on one of our adverts (including those shown on third party websites or via social media).

We may obtain some data from third parties

We may receive data about you from various categories of third parties, including:

  • from providers of services which facilitate our ecommerce operations, including ecommerce platforms and payment and fraud prevention services;
  • from analytics providers, advertising networks and search information providers;
  • from data partners;
  • from your friends who referred you using ‘refer a friend’;
  • from publicly available sources; and
  • from any third parties who are permitted by law or have your permission to share your personal data with us, such as via social media or review sites.

4. TYPES OF PERSONAL DATA WE COLLECT

How we collect data above described all the different ways in which it’s possible to be given or obtain data. Some of that data may be personal data and we explain below the types of personal data we may collect about you. Of course, the types of personal data we collect about you will depend on how you are interacting with us.

Personal data, or personal information, means any information about an individual from which that person can be identified. It does not include data where the identity has been removed (anonymous data).

We collect a variety of personal information about our customers and visitors to the MPowder website.

This personal data falls into these categories:

  • Identity Data includes title, gender, first name, maiden name, last name, date of birth, username or similar identifier and your login/password. If you interact with us through social media, this may include your social media user name.
  • Contact Data includes billing address, delivery address, email address and telephone numbers.
  • Financial Data includes payment card and direct debit/bank account details.
  • Transaction Data includes details about payments to and from you and other details of products and services you have purchased from us.
  • Profile Data includes your username and password, purchases or orders made by you, your interests, preferences, feedback and survey responses, as well as any profile data which we have added (for example, using analytics and profiling).
  • Technical Data includes internet protocol (IP) address, your login data, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform and other technology on the devices you use to access this website.
  • Usage Data includes information about how you use our website, products and services, and any of the content you contribute to the forum.
  • Tracking Data includes information we or others collect about you from cookies and similar tracking technologies, such as web beacons, pixels, and mobile identifiers.
  • Marketing and Communications Data includes your preferences in receiving direct marketing from us and your communication preferences.

We also collect, use and share Aggregated Data such as statistical or demographic data. Aggregated Data may be derived from your personal data but is not considered personal data in law as this data does not directly or indirectly reveal your identity. For example, we may aggregate your Usage Data to calculate the percentage of users accessing a specific website feature or to calculate the impact of our product against key symptoms over time.

However, if we combine or connect Aggregated Data with your personal data so that it can directly or indirectly identify you, we treat the combined data as personal data which will be used in accordance with this privacy policy.

We do not collect any Special Categories of Personal Data about you (this includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health and genetic and biometric data). Nor do we collect any information about criminal convictions and offences. If you share personal data referred to in this category we will not know and can only treat it as personal data. If you post any of this data on the forum, you have chosen to make it public online, and anyone can read it.

Remember, if you choose not to share personal data with us, or refuse certain contact permissions, we might not be able to provide the products and services you’ve asked for.

5. EXPLAINING THE LEGAL BASES FOR USING PERSONAL DATA

We will only use your personal data when the law allows us to. Most commonly, we will use your personal data in the following circumstances:

  • Where we need to perform the contract we are about to enter into or have entered into with you. For example, when you purchase our products, that’s a contract between you and us for us to supply the products to you.
  • Where it is necessary for our legitimate interests (or those of a third party) and your interests and fundamental rights do not override those interests. For example, fraud screening as part of the check-out process or keeping our website secure.
  • Where we need to comply with a legal or regulatory obligation. For example, keeping records of our sales for tax compliance.

Generally, we do not rely on consent as a legal basis for processing your personal data other than where the law requires it, for example in relation to sending certain direct marketing communications. Where our legal basis is consent, you have the right to withdraw consent any time.

See How and why we use your personal data below for more detailed information.

7. ADVERTISING, MARKETING AND YOUR COMMUNICATIONS PREFERENCES

There are lots of different ways you’ll see adverts for MPowder, and these may not be using your personal data – sometimes we buy advertising space in the real world and on websites and in social media. If you see MPowder’s adverts on websites and in social media, these may not be directed specifically at you, we may just have bid for the space. We may also be using a search engine or social media platform ‘lookalike’ products, which are not directed at you and which you can control using each search engine or social media platform’s privacy settings.

We may use your Identity, Contact, Technical, Tracking, Usage and Profile Data to form a picture of what we think you may want or need, or what may be of interest to you. This is how we decide which products, services and offers may be relevant for you and tell you about them. We may carry out direct marketing by email, phone, text and post.

On our website, we make your direct marketing preferences clear. We may also be able to send our customers relevant direct marketing about our own products and services unless they opted out during the purchase journey. We may also send you a little nudge as part of the purchase if you have left products in the basket without checking out.

At all times you have a right to opt out of direct marketing. The easiest way to opt out is to use the unsubscribe link at the bottom of the communication or just email us at info@mpowder.store.

We will get your express opt-in consent before we share your personal data with any third party company if ever required, but we don't do this currently.

We also work with partners to try and promote the reach of our adverts and use analytics and retargeting for this reason. We use Tracking Data to deliver relevant online advertising, including on websites and in social media.

Tracking Data, and in particular cookies, help us to deliver website and social advertising that we believe is most relevant to you and to potential new MPowder customers. The cookies used for this purpose are often placed on our website by specialist organisations – and this is also why when you’ve been on the MPowder website, you might see content from our website again. This is called retargeting.

Cookies can also tell us if you have seen a specific advert, and how long it has been since you have seen it. This is helpful, because it means we can control the effectiveness of our adverts and control the number of times people might be shown our adverts. Cookies also help us understand if you’ve opened a marketing email because we don’t want to send you things you don’t read.

If you want more information about Tracking Data, in particular cookies, see Cookies below.

Almost all the cookies that relate to advertising are part of third party online advertising networks. If you’d like to read about how you can control which adverts you see online, see opt-out programs established by the European Interactive Digital Advertising Alliance and the Digital Advertising Alliance (United States). We do not control cookies which are set by advertising networks.

8. COOKIES

A cookie is a small file of letters and numbers that we store via your browser.

Our website uses cookies to distinguish you from other users of our website. This helps us to provide you with a good experience when you browse our website and also allows us to improve our site.

We use the following categories of cookies:

  • Strictly necessary cookies. These are cookies which are needed to make the website work properly. They include, for example, cookies that enable you to log in, use a shopping cart or make secure payments.
  • Analytical/performance cookies. They allow us to recognise and count the number of visitors and to see how visitors move around our website when they are using it. This helps us to improve the way our website works, for example, by ensuring that users are finding what they are looking for easily.
  • Functionality cookies. These are used to recognise you when you return to our website. This enables us to personalise our content for you, greet you by name and remember your preferences (for example, your choice of language or region). These also allow us to tell if you’ve left any products in your basket without checking out.
  • Targeting cookies. These cookies record your visit to our website, the pages you have visited and the links you have followed. We will use this information to make our website relevant to your interests and for advertising and retargeting purposes. We may also share this information with third parties for this purpose.

Please note that third parties (including, for example, advertising networks and providers of external services like web traffic analysis services) may also use cookies, over which we have no control. These cookies are likely to be analytical/performance cookies or targeting cookies.

You block cookies by activating the setting on your browser that allows you to refuse the setting of all or some cookies. However, if you use your browser settings to block all cookies (including essential cookies) you may not be able to access all or parts of our site. For further information about how to block cookies, please refer to your browser ‘help’ section or All About Cookies.

Please be aware that if you delete your cookies, two things will happen:

  • We will no longer know that you've opted out of online behavioural advertising, so our adverts will still appear to you on other websites.
  • We will no longer automatically recognise any website preferences that you have set.

9. DISCLOSURES OF YOUR PERSONAL DATA

We may share your personal data with the third parties set out below for the purposes set out in this privacy policy. We may also share your personal data if the law otherwise allows it.

We may share personal data with the following categories of third parties:

  • suppliers and service providers (such as outsourced services partners, technology service providers, manufacturers and post and courier services);
  • payment services providers, via Shopify (see below) – payment processors may take your personal data directly from you as part of processing a purchase, and they will be data controllers in their own right for that processing;
  • auditors and professional advisers like bankers, lawyers, accountants and insurers; and
  • government, regulators and law enforcement.

We share personal data with the following specific third parties:

  • Shopify, who are the ecommerce platform we use for our website. The Shopify privacy policy tells you all the details you need to know about what information Shopify collects from you when you use our website or buy a MPowder product, and how Shopify may use and share it when we use them to support us with processing orders, risk and fraud screening, authentication and payments. You can read the full Shopify privacy here; in particular see the section about Information from buyers. Shopify also carries out some automated decision making, for example screening IP addresses or payment information to block potentially fraudulent transactions for a short period of time. If you have any questions about the Shopify privacy policy you can contact them directly.
  • Messagebird: to help us keep you updated on your delivery and to communicate via SMS
  • Hermes: to help us fulfil and deliver our orders.
  • Omni Channel Fulfilment: to help us fulfil and deliver our orders.

We also share data with third parties connected to advertising, retargeting and analytics. Please see Cookies above, including the cookie list, for more information about who those third parties are.

We may also share data with third parties to whom we may choose to sell, transfer, or merge parts of our business or our assets. Alternatively, we may seek to acquire other businesses or merge with them. If a change happens to our business, then the new owners may use your personal data in the same way as set out in this privacy policy.

We require all third parties to respect the security of your personal data and to treat it in accordance with the law. We do not allow our third-party service providers to use your personal data for their own purposes and only permit them to process your personal data for specified purposes and in accordance with our instructions.

10. INTERNATIONAL TRANSFERS

MPowder operates from the UK. We may share your data, for delivery purposes with fulfilment partners within the European Economic Area (EEA).

If we transfer your personal data out of the EEA, we will ensure a similar degree of protection is afforded to it and we will comply with the General Data Protection Regulation.

The standard contractual clauses used for international data transfers approved by the EU commission can be viewed here: https://ec.europa.eu/info/law/law-topic/data-protection/international-dimension-data-protection/standard-contractual-clauses-scc_en

11. DATA SECURITY

We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. In addition, we limit access to your personal data to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal data on our instructions and they are subject to a duty of confidentiality.

We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

12. DATA RETENTION

We will only retain your personal data for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements.

To determine the appropriate retention period for personal data, we consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal requirements.

By law we have to keep basic information about our customers (including Contact, Identity, Financial and Transaction Data) for six years after they cease being customers for tax purposes.

13. HOW TO CONTACT MPOWDER ABOUT PRIVACY

If you have any questions about this privacy policy, or would like to exercise any of your rights, please email us at info@mpowder.store or write to us with your letter addressed to: Data Privacy Manager, MPowder Limited, PO Box 71546, London SE10 1EX.

You have the right to make a complaint at any time to the Information Commissioner’s Office (ICO), the UK supervisory authority for data protection issues (www.ico.org.uk). We would, however, appreciate the chance to deal with your concerns before you approach the ICO so please contact us in the first instance.

14. THIRD-PARTY LINKS

This website may include links to third-party websites, plug-ins and applications. Clicking on those links or enabling those connections may allow third parties to collect or share data about you. We do not control these third-party websites and are not responsible for their privacy statements. When you leave our website, we encourage you to read the privacy notice of every website you visit.

15. IF YOU FAIL TO PROVIDE PERSONAL DATA

Where we need to collect personal data by law, or under the terms of a contract we have with you and you fail to provide that data when requested, we may not be able to perform the contract we have or are trying to enter into with you (for example, to provide you with goods or services). In this case, we may have to cancel a product or service you have with us but we will notify you if this is the case at the time.

16. CHANGE OF PURPOSE

We will only use your personal data for the purposes for which we collected it, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose.

If we need to use your personal data for an unrelated purpose, we will notify you and we will explain the legal basis which allows us to do so.

Please note that we may process your personal data without your knowledge or consent, in compliance with the above rules, where this is required or permitted by law.

17. YOUR LEGAL RIGHTS

Under certain circumstances, you have rights under data protection laws in relation to your personal data. Please click on the links below to find out more about these rights:

  • Request access to your personal data

This enables you to receive a copy of the personal data we hold about you and to check that we are lawfully processing it.

  • Request correction of your personal data

This enables you to have any incomplete or inaccurate data we hold about you corrected, though we may need to verify the accuracy of the new data you provide to us.

  • Request erasure of your personal data

This enables you to ask us to delete or remove personal data where there is no good reason for us continuing to process it. You also have the right to ask us to delete or remove your personal data where you have successfully exercised your right to object to processing (see below), withdrawn your consent, and there is no other lawful basis where we may have processed your information unlawfully or where we are required to erase your personal data to comply with local law. Note, however, that we may not always be able to comply with your request of erasure for specific legal reasons which will be notified to you, if applicable, at the time of your request.

  • Object to processing of your personal data

This enables you to object to processing of your personal data where we are relying on a legitimate interest (or those of a third party) and there is something about your particular situation which makes you want to object to processing on this ground as you feel it impacts on your fundamental rights and freedoms. You also have the right to object where we are processing your personal data for direct marketing purposes. In some cases, we may demonstrate that we have compelling legitimate grounds to process your information which override your rights and freedoms. The right to object to direct marketing purposes is absolute.

  • Request restriction of processing your personal data

This enables you to ask us to suspend the processing of your personal data in the following scenarios: (a) if you want us to establish the data’s accuracy; (b) where our use of the data is unlawful but you do not want us to erase it; (c) where you need us to hold the data even if we no longer require it as you need it to establish, exercise or defend legal claims; or (d) you have objected to our use of your data but we need to verify whether we have overriding legitimate grounds to use it.

  • Request transfer of your personal data

We will provide to you, or a third party you have chosen, your personal data in a structured, commonly used, machine-readable format. Note that this right only applies to automated information which you initially provided consent for us to use or where we used the information to perform a contract with you.

  • Right to withdraw consent

Withdraw consent at any time where we are relying on consent to process your personal data. However, this will not affect the lawfulness of any processing carried out before you withdraw your consent. If you withdraw your consent, we may not be able to provide certain products or services to you. We will advise you if this is the case at the time you withdraw your consent.

If you wish to exercise any of the rights set out above, please see How to contact MPowder about privacy above.

You will not have to pay a fee to access your personal data (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we may refuse to comply with your request in these circumstances.

We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.

We try to respond to all legitimate requests within one month. Occasionally it may take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.

18. FINALLY, A SMALL REQUEST FROM MPOWDER

It is important that the personal data we hold about you is accurate and current. Please keep us informed if your personal data changes during your relationship with us.
